This Privacy Policy describes the personal information KinoTek, Inc. (“KinoTek”, we”, “our”, or “us”) collects when how we use this information, with whom we share it, and the choices you have in connection with this. 

APPLICABILITY

This Privacy Policy applies to the KinoTek’s Website and Platform. The Platform and Website are collectively referred to herein as the “Services”.

DEFINITIONS

“Authorized User” means the individual(s) within Customer’s organization that are authorized to use the Platform.

“Customer” means the entity or Customer that has purchased a subscription to the Platform.

“Platform” means KinoTek’s 3D visualization platform.

“Website” means www.kinotek.com.

“Website Visitor” means any individual who accesses the Website.

INFORMATION COLLECTION AND USE

  1. Information Collected From Website Visitors

KinoTek will collect and use your personal information as a general Website Visitor in the following instances:

  • When you apply for employment with KinoTek, we will collect your name, email address, physical address, telephone number, and your professional or employment information (resume, cover letter, employment history, and educational history). We use this personal information to assess and manage your application, to communicate with you, and as necessary to comply with the law.

  • When you contact us, we collect your name, email address, any other information you choose to include in your correspondence. We use this personal information to respond to your questions or inquiries and address any issues you may have.

  • When you book a demo, we will collect your name and email address. We use this personal information to book your demo and communicate with you.

  • When you sign up for the KinoTek monthly newsletter, we will collect your email address to fulfill your request. You may opt-out of receiving our newsletter by clicking the “unsubscribe” link provided with each email. Please note that we will continue to send you emails necessary to the Website or any assistance you request.

  • KinoTek may use your personal information collected for the above purposes for the limited circumstances described in INFORMATION SHARING.

B.     Information Collected From Customers

KinoTek will collect and use your personal information as a Customer in the following instances:

  • When you contact us, we collect your name, email address, and any other information you choose to include in your correspondence. We use this personal information to respond to your questions or inquiries and address any issues you may have.

  • When you purchase a subscription, we will collect your name, billing address, and payment card information (card number, CVV, expiration date). We use this personal information to process your payment. Please note our payment processor collects and processes this information directly on our behalf and KinoTek only maintains historical payment information.

  • When you create an account for the Platform, we will collect your name, email address, physical address, and practice name. We use this personal information to create and maintain your account, communicate with you, and facilitate your access to the Platform.

  • KinoTek may use your personal information collected for the above purposes for the limited circumstances described in INFORMATION SHARING.

C.    Information Received From Customers

In providing the Platform, KinoTek may collect, use, share, and store “protected health information” received from a Customer who is a “covered entity” (your clinician) as the “business associate” of the Customer (as such italicized terms are defined by the Health Insurance Portability and Accountability Act of 1996, as amended, and its implementing regulations). As a business associate, KinoTek cannot use or disclose protected health information in a way that the Customer (as your clinician) itself may not. For information on how the Customer collects, uses, shares, and stores your protected health information, please refer to their notice of privacy practices.

D.    Information Collected From Authorized Users

KinoTek will collect and use your personal information as an Authorized User in the following instances:

  • When you contact us, we collect your name, email address, and any other information you choose to include in your correspondence. We use this personal information to respond to your questions or inquiries and address any issues you may have.

  • When you create an account for the Platform, we will collect your name, email address, physical address, and practice name. We use this personal information to create and maintain your account, communicate with you, and facilitate your access to the Platform.

  • KinoTek may use your personal information collected for the above purposes for the limited circumstances described in INFORMATION SHARING.

E.     Cookies

The Services use essential cookies, which are necessary to provide the Services. Without these cookies, the Services would not operate or function properly. Essential cookies collect information about your usage of the Services and your IP address. This information is necessary to identify your session within the Services so the Services can respond properly to your actions and requests. Essential cookies cannot be disabled. However, in general, to disable cookies and limit the collection of information through them, you can set your browser to refuse cookies or indicate when a cookie is being sent.

INFORMATION SHARING

KinoTek will share the personal information identified in this Privacy Policy in the following instances:

  • Where necessary, KinoTek will share your personal information within KinoTek to efficiently carry out and improve our business and to the extent permitted by law.

  • KinoTek will share personal information with service providers that perform services on KinoTek’s behalf. These service providers include our IT support, payment processor, and email vendor.

  • In the event that KinoTek enters into, or intends to enter into, a transaction that alters the structure of KinoTek, such as a reorganization, merger, acquisition, sale, joint venture, assignment, consolidation, transfer, change of control, or other disposition of all or any portion of our assets, KinoTek would share your personal information with third parties, including the buyer or target (and their agents and advisors) for the purpose of facilitating and completing the transaction. KinoTek would also share your personal information with third parties if KinoTek undergoes bankruptcy or liquidation, in the course of such proceedings.

  • KinoTek will share your personal information where legally required, such as in response to court orders, law enforcement or legal process, including for national security purposes; to establish, protect, or exercise our legal rights; to defend against legal claims or demands; to detect, investigate, prevent, or take action against illegal activities, fraud, or situations involving potential threats to the rights, property, or personal safety of any person; or to comply with the requirements of any applicable law.

CORRECT OR VIEW YOUR INFORMATION

You can access your KinoTek account to correct or view certain personal information of yours in our possession and which is associated with your account. 

DO NOT TRACK

The Services do not support Do Not Track (DNT).

INFORMATION SECURITY

KinoTek implements and maintains reasonable security measures to protect the personal information KinoTek collects and maintains. These security measures include access controls and encryption. However, no security measure or modality of data transmission over the Internet is 100% secure and KinoTek is unable to guarantee the absolute security of the information collected from you.

AGE RESTRICTION

The Services are not intended for use by individuals under the age of eighteen (18).

CHANGES TO THIS PRIVACY POLICY

KinoTek may change this Privacy Policy from time to time and will post the changes to this page and indicate the date the changes go into effect. We encourage you to review the Privacy Policy to stay informed. If KinoTek make changes that materially affect your privacy rights, we will notify you with a prominent post on the Services and obtain your consent, if required.
